Marital Relations and Menstrual Habit

Question:

If a woman's habit (regarding menstruation) the previous month was 4 days (for example), and the next month she bled 4 days and then during days 5-8 she did not bleed and then on days 9-10 she bled (and not on days 11 and any day afterwards) those 10 days would be considered hayd and her habit would have now changed from 4 days to 10 days. My question is what if her husband had relations with her during days 5-8 or she performed her prayer during days 5-8 (as they thought her hayd of 4 days was completed since there was no blood on the 5th day)? Would they be sinful?

Answer:

In the Name of Allah, Most Gracious, Most Merciful

Walaikum assalam wa rahmatullah,

No, they would not be sinful: sexual relations are permitted if the bleeding stops after the completion of the menstrual habit--as was the case in the situation described. If the bleeding stops before the completion of the menstrual habit, sexual intercourse remains impermissible in the Hanafi school until the menstrual habit [which is the last sound period of bleeding experienced] is complete, though it is obligatory to perform ghusl and pray. [Ibn Abidin, Radd al-Muhtar]

And Allah alone gives success.
