RE: Proofs for sunnah muakkada

Question:
You have said previously that someone continuously missing Sunnah Muakkada is sinful and will be deserving of punishment in the Hereafter. What is the reference in the Hanafi works for this?
Answer:
Walaikum assalam wa rahmatullah,
Ibn Abidin discussed this at length in his Radd al-Muhtar [1.70, see
below]
He makes clear that:
a) leaving the confirmed sunna once without excuse is blameworthy but not
sinful;
b) making it a habit to leave it, however, is sinful, though less sinful
than leaving a wajib.
And Allah alone gives success.

س: ما حكم ترك السنة المؤكدة؟
ح: ترك السنة المؤكدة بلا غذرٍ مكروه و تاركها يستحق اللوم
والعتاب لكنه لا يأثم إلا إن اعتاد تركها.
قال سيدي ابن عابدين في ردّ المحتار: (1/70)
. وَفِي التَّحْرِيرِ : إنَّ تَارِكَهَا يَسْتَوْجِبُ التَّضْلِيلَ
وَاللَّوْمَ , . ا هـ . وَالْمُرَادُ التَّرْكُ بِلَا عُذْرٍ عَلَى سَبِيلِ الْإِصْرَارِ
كَمَا فِي شَرْحِ التَّحْرِيرِ لِابْنِ أَمِيرِ حَاجٍّ , وَيُؤَيِّدُهُ مَا سَيَأْتِي
فِي سُنَنِ الْوُضُوءِ مِنْ أَنَّهُ لَوْ اكْتَفَى بِالْغَسْلِ مَرَّةً إنْ اعْتَادَهُ
أَثِمَ , وَإِلَّا لَا . وَفِي الْبَحْرِ مِنْ بَابِ صِفَةِ الصَّلَاةِ : الَّذِي
يَظْهَرُ مِنْ كَلَامِ أَهْلِ الْمَذْهَبِ أَنَّ الِاسْمَ مَنُوطٌ بِتَرْكِ الْوَاجِبِ
أَوْ السُّنَّةِ الْمُؤَكَّدَةِ عَلَى الصَّحِيحِ ; لِتَصْرِيحِهِمْ بِأَنَّ مَنْ
تَرَكَ سُنَنَ الصَّلَوَاتِ الْخَمْسِ قِيلَ : لَا يَأْثَمُ وَالصَّحِيحُ أَنَّهُ
يَأْثَمُ , ذَكَرَهُ فِي فَتْحِ الْقَدِيرِ , وَتَصْرِيحُهُمْ بِالْإِثْمِ لِمَنْ
تَرَكَ الْجَمَاعَةَ مَعَ أَنَّهَا سُنَّةٌ مُؤَكَّدَةٌ عَلَى الصَّحِيحِ وَكَذَا
فِي نَظَائِرِهِ لِمَنْ تَتَبَّعَ كَلَامَهُمْ , وَلَا شَكَّ أَنَّ الْإِثْمَ مَقُولٌ
بِالتَّشْكِيكِ بَعْضُهُ أَشَدُّ مِنْ بَعْضٍ , فَالْإِثْمُ لِتَارِكِ السُّنَّةِ
الْمُؤَكَّدَةِ أَخَفُّ مِنْ الْإِثْمِ لِتَارِكِ الْوَاجِبِ . ا هـ . قَالَ فِي
النَّهَرِ هُنَاكَ : وَيُؤَيِّدُهُ مَا فِي الْكَشْفِ الْكَبِيرِ مَعْزِيًّا إلَى
أُصُولِ أَبِي الْيُسْرِ : حُكْمُ السُّنَّةِ أَنْ يُنْدَبَ إلَى تَحْصِيلِهَا
, وَيُلَامَ عَلَى تَرْكِهَا مَعَ لُحُوقِ إثْمٍ يَسِيرٍ .
